| PRIZE |
1. Three (3) Prizes will be awarded. Each winner will receive a 4 day 3 night expenses paid trip for two to Rolling Loud® Festival at Legend Siam, Pattaya, Thailand from April 13 to April 16, 2023 as described further below (the “Prize”).
2. Each Prize includes:
- Return flights on economy class between Kuala Lumpur, Malaysia and Bangkok for winner and one (1) winner’s guest (“Travel Companion”)
- 3 nights of accommodation for winner and Travel Companion in a 4-star hotel in Pattaya, Thailand (on double occupancy basis)
- Two-way ground transportation between Bangkok international airport and hotel in Pattaya for winner and Travel Companion
- Two 3-day VIP Entry tickets to Rolling Loud® Festival in Legend Siam, Pattaya, Thailand from 13 April 2023 to 15 April 2023 (“Festival”) for winner and Travel Companion;
- Two-way transfer between hotel and Rolling Loud® Festival venue for winner and Travel Companion for 3 days Retail Value of the Prize: MYR 6,000 (per winner); actual value may vary.
3. Festival ticket delivery method is at sole discretion of Rolling Loud® which will be either sent to winner by mail, email, mobile ticketing or placed at venue Will Call the day of Festival under the winner’s name. Winner must be present to pick up tickets and a valid photo ID will be required if tickets are placed at Will Call. Winner and guests must abide by all Festival/venue policies. Rolling Loud® reserves the right to revoke full or partial prize from any winner or winner’s guest who it and/or Festival/venue personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any Festival/venue policy or law, and/or may bring Rolling Loud® into disrepute. Resale of tickets is prohibited. By claiming tickets, you agree to Festival Tickets Terms of Use and to abide by the health and safety measures in effect at the time of the Festival, which may include, but not be limited to, wearing masks, providing proof of vaccination status and/or providing proof of negative COVID-19 status. Should the Festival be cancelled, you will be notified as soon as reasonably possible.
4. All Prize details will be determined in the sole and absolute discretion of Promoter. Personal expenses, travel and other relevant insurances, meals, transfer and all other items not identified above are specifically excluded.
5. Winner is fully responsible for any and all applicable taxes (including income and withholding taxes). All costs and expenses associated with the Prize, acceptance, and use not specified herein as being provided, are the sole responsibility of the Winner.
6. Prizes are not transferable, exchangeable or redeemable for cash. Further, Promoter reserves the right to substitute the Prize (or any portion thereof) with a prize of comparable or greater value at its sole and absolute discretion.
7. Winner and Travel Companion must:
- possess valid passports with at least 6 months’ validity period from date of departure,
- valid travel visas (if applicable). If winner fails to secure a valid travel visa which renders winner’s inability to travel, winner will be deemed to have forfeited the Prize.,
- be responsible to comply with all travel requirements and regulations of home and destination countries, including without limitations, applicable health formalities and laws relating to Covid-19.,
8. Travel Companion, if any, must be at least 21 years of age, unless accompanied by a parent or legal guardian. In the event winner requests for a change of Travel Companion, at Promoter’s sole discretion and time permitting, Promoter may accept winner’s request and winner shall bear all costs associated with effecting the change as incurred by Promoter.
9. Winner and Travel Companion agree to comply with all applicable venue regulations and terms and conditions of use imposed by the merchants and service providers in connection with the Prize. |
| OTHER TERMS |
1. The Promotor reserves the right to verify the validity of entries and to disqualify any entry or refuse to award the Prize where false or misleading details have been given by you, or you have behaved in a fraudulent or dishonest manner or in breach of any of these Contest Terms. Any entry not complying with these Contest Terms is invalid. Errors and omissions may be accepted at the Promoter's discretion.
2. All personal data (as defined under the Malaysian Personal Data Protection Act 2010) you provide us at any point in time in connection with the Contest and when signing up to become a Levi’s® Red Tab Program member will be processed, used and disclosed for the purpose of running, managing, providing and operating the Contest, and/or as otherwise set out in the Privacy Policy. By entering this Contest, each Entrant gives his/her express consent and permission to be contacted by the Promoter by telephone and/or email for the Contest purposes. This Paragraph 2 shall be in addition to the terms contained in the Privacy Policy (which shall equally apply to the processing of personal data pursuant to the Contest). In the event of any conflict or inconsistency between these Contest Terms and the Privacy Policy, these Contest Terms shall prevail solely in relation to the conflicting provision.
3. The winning Entrant ("Winner"), in accepting the Prize, irrevocably and unconditionally:
- consents to the disclosure of Winner’s personal data to third parties (which may include, any third party logistics, tour and/or event organiser) for the purposes of providing and delivering the Prize to Winner;
- consents and grants to the Promoter and its related corporation, the right and licence to use, process, advertise, market, post, reproduce, make public and publish: (i) the name and/or address (city and state/territory of residence) of the Winner; and (ii) photograph(s), voice recording(s), statement(s), image(s), video footage(s), sound recording(s) and/or other likeness (or any part thereof) of the Winner, which the Promoter and/or its appointed agent or sub-contractor or the like, have taken or made of the Winner (in color or otherwise), in relation to the Contest, the Prize, the award of the Prize and the Winner's use and enjoyment of the Prize (including the Winner's attendance at events forming part of the Prize or at which the Prize is awarded) (collectively the "Captured Material"); and
- grants to the Promoter and its related corporation, the right to copyright the Captured Material, for advertising, promotional, trade and/or any other purpose as Promoter deems fit, in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by applicable law. By participating in the Contest and submitting an entry, an Entrant who is a Winner agrees, to waive any and all rights which it may have in the Captured Material (including the right to any compensation or royalties) for the abovementioned uses and releases Promoter from any and all liabilities or claims which the Winner may assert in connection with the abovementioned uses and the Winner's appearance in the Captured Material.
4. WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Contest and submitting an entry, each Entrant (a) agrees to be bound by these Contest Terms and the Privacy Terms; and (b) waives any and all claims against the Promoter and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, Live Nation Worldwide, Inc., (“Live Nation”), More Return Public Company Limited; More Dan Nusa Entertain Co. LTD; Insomniac Holdings, LLC; BZTC LLC; Rolling Loud, LLC and any other parties, as designated by Live Nation, and each of their respective parents, partners, divisions, subsidiaries, shareholders, officers, directors, members, managers, agents, affiliates, and employees (collectively “Rolling Loud”) and any and all other companies associated with the Contest, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any injury, death, damage or loss (financial or otherwise) that may occur, directly or indirectly, in whole or in part, from the participation in the Contest or from the receipt or use of the Prize (or any portion thereof) or any travel or activity related to the receipt or use of the Prize (or any portion thereof).
5. Released Parties (a) make no warranty, guarantee or representation of any kind concerning the Prize (or any portion thereof), and (b) disclaim any implied warranty which may be applicable to the Released Parties, to the extent permissible under applicable laws. Released Parties are not agents of the merchant or service providers of the any part of the Prize and assumes no liability or responsibility for the acts or defects in the goods, or delay, cancellations or unsatisfactory delivery of services offered in any part of the Prize for any reasons howsoever arises. Any dispute about the quality or service standard must be resolved directly with the merchant or service providers providing the Prize. The merchant or service providers may impose conditions for the use of the goods or services relating to the Prize and Released Parties will not be responsible for any injury, loss or damage suffered as a result of the usage of the goods and services or in connection with the Contest and/or acceptance or use of the Prize.
6. The Promotor shall not be liable for any failure to record an entry into the Contest due to: (i) reasons beyond their control (including due to internet connectivity issues or system glitches); and (ii) any omission or oversight by its employees, officers and/or its agents. The Promoter will not be responsible for any late, lost or misdirected entries, including but not limited to entries received due to technical problems. Records of the Promoter and its agencies are final and conclusive as to the time of receipt of an entry. Participants are solely responsible for internet connectivity, and software and/or hardware that may be required in order to submit an entry.
7. If for any reason the Contest is not capable of running as planned (including, but not limited to infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest), the Promoter may, subject to the approval of all relevant regulatory authorities, take any action that may be available including cancelling, terminating, modifying or suspending the Contest.
8. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
9. Except where prohibited by law, these Contest Terms are governed by and construed in accordance with the laws of Malaysia. Any action, suit, or case arising out of, or in connection with, the Contest or these Contest Terms falls within the jurisdiction of the federal or state courts located in Kuala Lumpur, Malaysia. As a condition of entering this Contest, each Entrant agrees that, where permissible under applicable laws, under no circumstance will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses. The invalidity or unenforceability of any provision of these Contest Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Contest Terms shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials and the terms and conditions of these Contest Terms, these Contest Terms shall prevail.
10. Live Nation and Rolling Loud® are not sponsors or the administrators of this Promotion, and not responsible for the selectionor verification of winners or the fulfillment of prizing. All inquiries should be directed to Promoter and not to Live Nation or Rolling Loud.
